Terms of Service

By accessing or using Joltibase (“the Service”), operated by Joltibase (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Joltibase is an AI-powered marketing automation platform that allows users to generate, design, and send campaigns and automations. The Service includes AI-assisted content generation, a visual email editor, contact management, analytics, and automation features.

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this requirement.

Joltibase offers a free tier and paid subscription plans. Paid subscriptions are billed monthly or annually as selected at the time of purchase.

All payments are processed by Paddle.com Market Limited (“Paddle”), our merchant of record. Paddle handles all billing, invoicing, sales tax, and payment disputes on our behalf. By subscribing to a paid plan, you also agree to Paddle’s Terms of Service.

Prices are displayed in euros (€) and may be subject to applicable taxes depending on your location, which Paddle calculates and collects.

The free tier provides limited access to the Service, including a restricted number of AI generations and test email sends only. Sending campaigns to contacts requires a paid subscription.

We reserve the right to modify usage limits for any tier with reasonable notice.

You agree not to use the Service to:

• Send unsolicited bulk email (spam) or violate anti-spam laws (CAN-SPAM, GDPR, etc.)
• Send emails containing malware, phishing attempts, or deceptive content
• Distribute content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Impersonate any person or entity, or falsely represent your affiliation
• Attempt to gain unauthorized access to the Service or its related systems
• Use the Service to collect personal data without proper consent
• Resell or redistribute the Service without our written permission

We reserve the right to suspend or terminate accounts that violate these terms without notice.

Your content. You retain full ownership of all email content, designs, contact data, and other materials you create or upload to the Service. We do not claim any intellectual property rights over your content.

AI-generated content. Emails generated by our AI tools are considered your content. You are free to use, modify, and distribute them as you see fit.

Our service. The Service, including its design, interface, code, and underlying technology, is owned by Joltibase and protected by applicable intellectual property laws. You may not copy, modify, or reverse-engineer any part of the Service.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

By using the AI features, you acknowledge that email content you provide as prompts may be processed by third-party AI providers (Anthropic) to generate responses. We do not use your content to train AI models.

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability.

We are not liable for any damages arising from service interruptions, data loss, or delivery failures.

While we use industry-standard practices to maximize email deliverability, we cannot guarantee that emails sent through the Service will be delivered to recipients’ inboxes. Deliverability depends on factors outside our control, including recipient email providers and content filtering.

You may cancel your subscription at any time from your account settings. Upon cancellation, you retain access to paid features until the end of your current billing period.

We may terminate or suspend your account if you violate these terms, with or without notice. Upon termination, your right to use the Service ceases immediately, though we will make your data available for export for a reasonable period.

To the maximum extent permitted by law, Joltibase shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Joltibase and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes take effect constitutes acceptance of the updated terms.

These Terms are governed by and construed in accordance with the laws of Norway. Any disputes shall be resolved in the courts of Norway.
